Campaign Butler Terms of Service
Effective Date: September 5, 2025
These Terms of Service (“Terms”) constitute a legally binding agreement between you (individually or on behalf of an entity) and Campaign Butler (“Campaign Butler,” “we,” “us,” or “our”). By accessing or using our websites, applications, software, and other services (collectively, the “Services”), you agree to be bound by these Terms. If you do not agree with these Terms, you must discontinue use of the Services.
1. Introduction and Acceptance
Campaign Butler provides digital tools and services to help political campaigns build a website, manage voter outreach and volunteer activities, collect donations, and analyze campaign performance. The Services include but are not limited to:
- A website builder and hosting platform with domain registration and cybersecurity features.
- Voter outreach tools such as targeted email campaigns, phone‑banking systems and compliant SMS messaging.
- A voter contact list database and data‑synchronization across channels.
- A volunteer walking app (door‑to‑door canvassing) and a unified analytics dashboard.
These Terms describe your rights and obligations when using our Services, including important limitations and exclusions. We reserve the right to update these Terms and will notify you of material changes as required by law. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
2. Definitions
- Account: The user‑specific login credentials and profile created to access the Services.
- Campaign Content: Any data, text, graphics, images, videos, audio, documents or other materials you upload, post or transmit through the Services.
- Personal Data: Any information that directly or indirectly identifies an individual, including names, contact details and voter information.
- Third‑Party Services: Products or services offered by third parties that integrate with or are accessible through the Services (e.g., payment processors, email providers, analytics tools).
- User: Any individual or organization that accesses or uses the Services.
3. Eligibility and User Responsibilities
You must be at least 18 years old and have the legal capacity to enter into this agreement. By creating an Account, you represent and warrant that:
- You will provide accurate, current and complete registration information and promptly update it as necessary.
- You will maintain the confidentiality of your Account credentials and are solely responsible for all activities that occur under your Account.
- You have obtained any necessary permissions and consents from voters or supporters before sending them emails, calls or SMS messages through our Services.
- You will comply with all applicable laws and regulations, including election laws, campaign finance rules, the Telephone Consumer Protection Act (TCPA) and CAN‑SPAM, and the terms of any third‑party service you connect to the Services.
- You have authority to bind any campaign or entity on whose behalf you use the Services.
4. Description of Services
The Services enable you to:
- Build and host a campaign website. We provide a customizable website builder, hosting infrastructure, and optional domain registration with cybersecurity protections.
- Collect online donations. The Services may integrate with third‑party payment processors to facilitate online contributions. Processing of donations is handled by the respective payment processor, and Campaign Butler does not hold donor funds.
- Contact voters through multiple channels. You can upload or create a voter contact list and send targeted emails, SMS/MMS text messages and phone calls. The platform includes a phone‑banking system and a volunteer walking app to organize door‑to‑door canvassing.
- Analyze campaign performance. A unified analytics dashboard and data‑synchronization tools allow you to track engagement and optimize your outreach.
The specific features available to you may depend on the package or subscription you select. We reserve the right to modify or discontinue features at any time.
5. Pricing and Payment
Our pricing may include one‑time fees (e.g., for domain setup) or recurring subscription fees (e.g., monthly or annual). You agree to pay all applicable fees when due. Prices are exclusive of taxes unless otherwise stated. We may modify prices or introduce new fees upon reasonable notice. If you purchase a subscription, it will automatically renew at the end of each billing period unless you cancel before renewal. We do not guarantee refunds except where required by law. Additional charges may apply for text messaging (carrier fees) or transaction fees charged by third‑party payment processors.
6. Permitted Use
Subject to your compliance with these Terms, we grant you a limited, non‑exclusive, non‑transferable right to access and use the Services solely for lawful campaign purposes. Permitted uses include:
- Creating and managing a campaign website and digital presence.
- Collecting lawful donations through integrated payment processors.
- Communicating with supporters and voters via email, phone and SMS messaging, provided that you have obtained all required consents and comply with applicable laws.
- Organizing volunteers and canvassing activities.
- Accessing and analyzing campaign data and metrics.
7. Prohibited Conduct
You agree not to, and will not permit others to:
- Use the Services for any illegal, fraudulent or unauthorized purpose.
- Send unsolicited mass communications, spam, harassing or threatening messages, or content that violates privacy, intellectual property or other rights.
- Misrepresent your identity or your campaign, or provide false or misleading information.
- Access or use any third‑party service or API in a manner that violates its terms or applicable laws.
- Circumvent or attempt to circumvent API limits or security measures; reverse engineer or otherwise extract source code from our Services or third‑party APIs.
- Introduce malware, viruses, worms or other harmful code.
- Collect, store or transmit any sensitive data (e.g., protected health information, data regulated under the International Traffic in Arms Regulations) via the Services.
- Use the Services for activities where failure could result in death, personal injury or environmental damage (e.g., life‑support systems).
- Use the Services if you are under 18 or otherwise prohibited from using them by law.
8. User Content and Intellectual Property
You retain ownership of your Campaign Content. By submitting Campaign Content to the Services, you grant Campaign Butler a worldwide, non‑exclusive, royalty‑free license to host, reproduce, publicly display, distribute, and otherwise use the content solely for the purpose of operating and providing the Services. You are solely responsible for ensuring that your Campaign Content (i) does not violate any law or third‑party rights, and (ii) does not contain offensive, defamatory or harmful material.
All intellectual property rights in the Services, including our trademarks, software, designs, text, graphics and logos, are owned by or licensed to Campaign Butler. Except as expressly permitted, you may not copy, modify, sell, or create derivative works of the Services or content provided by us.
9. Third‑Party Services and Integrations
9.1 General
The Services may integrate or interoperate with Third‑Party Services such as payment processors, domain registrars, analytics providers, and email or messaging platforms. Accessing or using these Third‑Party Services may require you to accept separate terms or privacy policies. You are solely responsible for reviewing and complying with those terms. Campaign Butler does not license any intellectual property of third parties to you and is not liable for any third‑party services or content.
9.2 Google Services
If you connect a Gmail account or use our Google Cloud SMTP/Gmail integration to send emails through the Services, you authorize Campaign Butler to access and send email on your behalf via Google’s APIs. Use of Google APIs is subject to Google’s terms, including the Google APIs Terms of Service and Google API Services User Data Policy. We will only access, use and store Google user data as necessary to provide the email functionality and will not share your Google credentials or email content with third parties except as required to deliver the Services. Google may monitor API use and suspend access for violations. You must not exceed usage limits, misrepresent your identity or circumvent security controls. 9.3 Microsoft/Outlook and Other Email Providers
If you connect a Microsoft Outlook or other email account, you authorize us to send emails via those providers’ APIs or SMTP servers. Your use of these services is governed by the provider’s terms (e.g., Microsoft Services Agreement). Microsoft advises that using its services may require you to share your content or data with third parties, and you should review the third‑party terms before linking your account. You assume all risk and liability arising from your use of Third‑Party Apps and Services, and Microsoft (or other providers) are not responsible for any issues arising from such use. Campaign Butler does not store your Outlook or other provider passwords; instead we use OAuth tokens and will only access your account to send emails you authorize.
9.4 Payment Processors and Donations
Online donations made via the Services are processed by independent payment processors. We do not control, and are not responsible for, the security or performance of these processors. You acknowledge that the payment processor’s terms and privacy policies govern your transactions. Campaign Butler does not act as a fiduciary or escrow agent; all donation funds go directly to the campaign.
10. Communications and Messaging
The Services include tools for sending email, phone calls and SMS/MMS text messages to supporters and voters. By providing your phone number or email address, you consent to receive messages from Campaign Butler as described in our sign‑up form. Message frequency may vary and carrier rates may apply. You can opt out at any time by replying “STOP” or following the instructions in the message.
If you use our voter contact tools, you are responsible for ensuring that each recipient has provided informed consent to receive communications and that your messages comply with applicable laws, including the TCPA and CAN‑SPAM Act. You will not send unlawful, harassing, defamatory or unsolicited messages through the Services. Campaign Butler may suspend or terminate your access if your communications violate these Terms or applicable law.
11. Service Availability and Disruption
We strive to keep the Services available, but we do not guarantee uninterrupted access. The Services, Third‑Party Services or content may be unavailable from time to time due to maintenance, updates, system failures or other reasons. We are not liable for any loss or harm caused by such interruptions. You are responsible for backing up any Campaign Content and data stored on the Services, and we recommend exporting important information regularly.
12. Termination
These Terms remain in effect until terminated. You may stop using the Services at any time by closing your Account. We may suspend or terminate your Account or access to any portion of the Services if you violate these Terms, engage in suspected fraudulent activity, or if required by law. We may also discontinue the Services or any part thereof with reasonable notice. Upon termination, your license to use the Services ends and we may delete your Campaign Content after a reasonable period, except where retention is required by law or for legitimate business purposes.
13. Disclaimers and Limitation of Liability
The Services are provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Services will be uninterrupted, error‑free or secure, or that any defects will be corrected. To the maximum extent permitted by law, Campaign Butler disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose and non‑infringement.
Campaign Butler will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use or goodwill arising from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party; (iii) any content obtained from the Services; or (iv) unauthorized access, use or alteration of your transmissions or content. In no event shall our aggregate liability exceed the amount you paid to Campaign Butler for the Services during the twelve months preceding the claim. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.
14. Indemnification
You agree to indemnify, defend and hold harmless Campaign Butler, its affiliates, directors, officers, employees and agents from any claim, demand, damages, losses, liabilities, costs and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Services; (b) your violation of these Terms or any applicable law; (c) your Campaign Content; (d) your communications sent through the Services; or (e) any dispute between you and a third party. We reserve the right to assume control of any matter subject to indemnification, in which case you will cooperate with us.
15. Governing Law and Dispute Resolution
These Terms and any dispute arising out of or relating to them or the Services shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles. You agree that any legal suit, action or proceeding arising out of or related to these Terms or the Services shall be instituted exclusively in the federal or state courts located in Arizona, and you consent to the personal jurisdiction of such courts.
At our sole discretion, we may require you to submit any dispute arising from these Terms or the Services to binding arbitration in Arizona. If arbitration is mandatory, you agree to waive your right to litigate in court and to participate in a class action.
16. Changes to Terms
We may revise these Terms from time to time to reflect changes to the Services, legal requirements or for other reasons. We will post the updated Terms on our website and, if the changes are material, provide notice as required by applicable law. Your continued use of the Services after the effective date of any revised Terms constitutes your acceptance of the updated Terms.
17. Miscellaneous
These Terms constitute the entire agreement between you and Campaign Butler regarding your use of the Services and supersede any prior agreements. If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions will remain in full force. Our failure to enforce any right or provision does not constitute a waiver of such right or provision. You may not assign your rights or obligations under these Terms without our prior written consent; we may assign these Terms without restriction.
